DACA Is Ruled ‘Unlawful’ – What Does This Mean?

The Deferred Action for Childhood Arrivals, also known as DACA, deserves better. Sure, those who already benefit – an estimated 600,000 young immigrants – from the program are still covered, but the three-judge panel of the U.S. Court of Appeals for the Fifth Circuit ruled it unlawful. No newcomers are able to benefit from the program.

What does this mean?

According to The New York Times, the ruling translates to: “in essence keeping the status of the program unchanged but its future uncertain.” They also point out that “The Biden administration will need to continue its legal fight to enroll new applicants in the program.” But will they put more effort to make permanent – and positive – changes for our Dreamers?

“Yesterday’s Fifth Circuit decision that DACA is unlawful is the result of efforts by MAGA Republican officials to strip people of their protections,” President Joe Biden wrote online. “I’m committed to defending Dreamers. It’s time that Congress pass permanent protections, including a pathway to citizenship.”

Let’s hope we see action from our President soon.

Of course, he isn’t the only one with strong opinions about what’s happening. “The Fifth Circuit’s decision is wrong on the merits and bad for our country. This ruling was made by three GOP judges who put their political agenda ahead of the law – and ahead of the lives of hundreds of thousands of Dreamers who have benefited from this program,” Voto Latino’s President Maria Teresa Kumar said in a written press statement.

She mentioned that DACA recipients have “strengthened our community and our country in countless ways,” and that they’ve “enriched this nation immeasurably.” She also highlights the 343,000 individuals that were frontline workers during the pandemic.

“The next step is clear: Congress must act to protect Dreams and the communities they’re part of.” She encourages everyone to use the midterm elections to send a “clear signal” that we support Dreamers. 

We hope we see positive news from the government soon. Also, those in our community who can vote, do so.
