Over half of Mexico’s population is Catholic, yet they were able to set their beliefs aside for the sake of body autonomy. 

In a historic move, Mexico’s Supreme Court has taken a significant step towards the decriminalization of abortion.  

This sweeping decision not only challenges the nation’s deeply entrenched conservative stance on abortion but also extends the trend of expanding abortion access seen across Latin America. 

What Mexico’s Ruling on Abortion Means for Body Autonomy

The Mexican Supreme Court’s ruling, which declared federal criminal penalties for abortion unconstitutional, is being hailed as a major victory for women’s rights. According to AP News, the decision essentially abolishes laws that prohibited abortion at the national level and underscores the importance of women’s reproductive autonomy. 

This groundbreaking ruling means that abortion will no longer be criminalized under Mexico’s federal penal code. Furthermore, it obliges the federal public health service and all federal health institutions to provide abortion services upon request. This momentous shift is poised to have a profound impact on reproductive rights and access to safe and legal abortion in Mexico. 

The Supreme Court’s decision emphasizes that the legal system criminalizing abortion in Mexican federal law was inherently unconstitutional. The ruling unequivocally asserts that such laws violate the human rights of women and individuals with the capacity to gestate.  

Mexico has long been known for its restrictive abortion laws, where the procedure was typically only allowed in cases of rape or when the mother’s (or birthing person’s) life was in danger. However, this new ruling challenges the status quo and opens the door to a more inclusive and progressive approach to reproductive rights.

They argue that it undermines Mexico’s moral foundations and have vowed to continue their fight against what they perceive as a threat to their beliefs.

The ruling represents a critical step forward, but the battle for women’s reproductive autonomy in Mexico is likely to continue.
